Shame on the ABC website for such pathetic news item not one piece of it
accurate


ABA investigates pirate **** broadcasts

****ographic television channels are allegedly being illegally broadcast
into Australia via satellite.

It is believed Australians are able to watch the channels by purchasing a
so called "smart card" on the Internet that enables their satellite to pick
up the broadcast.

Four shows are currently under investigation by the Australian Broadcasting
Authority (ABA).

Authority spokesman Jenny Brigg says any Australians caught selling the
cards will find themselves in court.

"It's illegal to broadcast that content into Australia and if you're doing
it with a smart card, well that, that's just the way that you're doing it,"
she said.

"It's actually illegal when they're being broadcast via satellite into
Australia so the laws are quite clear about that.

"What is harder is if we find that it is someone from overseas what we can
actually do to enforce those laws."

Its not transmitted from Australia the ABA rules don't even apply

From my understandings

It is illegal to broadcaste within australia
It is illegal to supply access or provide a card to access *** material

The ABA have no power if
The material is being broadcast into Australia from overseas
The card is purchased overseas

and I belive (I may be wrong) it is not illegal for a person to have a card
allowing access in Australia, but it would be illegal for you to sell that
card within Australia

No govt gets any say on what other countrys
can do from satellites that they own.


Have fun pointing to the legislation that says that
with a service that isnt broadcast in this country.

Have fun listing the legislation that says that last bit.
