Gosh I hope this Weight Watchers Lawsuit takes off (exercise)
Note that no actual suit has been filed. I'm still getting
my bachelor's as a paralegal, but I would bet Orbach will have
to show that Weight Watchers adverti*****ts with testimonials
never say "results not typical" and other such disclaimers.
She is also going to have to overcome expert testimony from a
study that the FTC did some years back which shows that Weight
Watchers works better than Jenny Craig and some other plans for
more people. Most of us here already know that just changing
your eating habits isn't enough, that you also have to exercise,
and Orbach is going to have to show that Weight Watchers never
says anything about needing to exercise. From some postings on
this newsgroup, I know that Weight Watchers does deal with
exercise. So even if she ever gets to court, I doubt she will
win. But like I say, I'm not even a fully trained paralegal
yet, let alone an attorney.
Her lawyer must have dollar signs for eyeballs for letting her
go forward against Weight Watchers without including other
commercial programs and products.
