Default Quitting work due to depression/job stress? Unemployment?


I have been planning to leave my job for a while in order to start my
own business. I had planned to stay a few more months until I paid off
some outstanding bills, then leave. However, my doctor wants me to
quit ASAP due to the emotional toll work stress is taking on my
health. I have suffered with depression for several years, and meds
have worked wonderfully thus far. The work stress has become
overwhelming though.

I am all for leaving ASAP, but I still have to pay off those bills. I
could possibly apply for long-term disability, collect partial salary
for a few months, then quit. But I seem to remember a former coworker
quitting for the same reason, with a doctor's note, and then
collecting unemployment. I would like to do this if possible.

My doctor didn't know how to go about doing this, but she did say she
would provide whatever do***entation was needed. I would ask my HR
person, but I don't trust her to keep our conversation confidential
(is she legally bound to keep it to herself?)

Any help or suggestions would be greatly appreciated!

No, she doesn't. She isn't a doctor or therapist, so those laws don't apply to her.


The only way to know for sure is to call your state's unemployment
office and ask. Anything else posted here would be pure speculation
as the laws vary from state to state, and you never said what state
you are in.

Was it unemployment or disability?
Could you look into short term or long term disability?
Would your doctor say you qualify for disability?

What kind of business do you want to start? How long would it take you to
get that off the ground, and how much would it cost?

Do you get disability benefits where you work? Maybe your doc can write a
not so you fit into that, if you qualify.
Pull out your benefits package, and read the fine print. Also look into the
unemployment and disability laws for your state.

Don't elaborate on things with your HR person, other than maybe getting
copies of your benefits package. If you start asking her about disability,
she very likely has no obligation to keep quiet that you asked. That may
raise an eyebrow or two.
