The NHL season is dead — again. After 6 1/2 hours of
negotiations, with Wayne Gretzky and Mario Lemieux at the
bargaining table, talks broke down Saturday, leaving the already
canceled hockey season beyond saving.

That's probably how NBC feels, their after-costs revenue sharing
deal for the NHL starts when the NHL starts ... whenever.

Meanwhile, the people at Disney are breathing a sigh of relief
because they would be on the hook for $60 Million this year.
Now, they didn't have to spend a penny, replacement shows
are getting double the ratings that the NHL had, and their
obligation was only tied to this season; they have two (but
other reports say three) option years that they can cancel
on April 15. It still amazes me, they overpaid $600 Million
over five years and then were willing to overpay $60 Mill
for this season when there was no competing bid!

What is more likely is that the NHL will buy out the Mighty
Ducks from their stoppage fund and let ESPN show any
and all games for free.

No, it doesn't. The Cup is in Trust to a Trustee
composed of two sitting members. Both members are
highly sympathetic to the NHL.
But the dominant legal opinion is that it is held in a
private, not public, trust. If it should go to court,
and it can only go to court in Canada, that will be the
test. Is it a public (and thus charitable) Trust?

If it is ruled to be public, then the court can proceed
to add rulings to the Trust do***ent.
If it is private, the court can rule on the actions
of the Trustee only if the grantee (and we don't have
any idea who that is) brings an action.

So the Trust can be amended, but only through very lengthly
legal action.

I'm currently heading to court on a trust action that is
equally as messy and vicious. It involves a public park
in my hometown. It ain't pleasant.

Well, thanks for some very interesting feedback. As a Canadian I have
some feelings that aren't do not come from law books. It would be
good to know that this cup which is part of our heritage remain in
Canadian hands and not in the hands of foreign financial folks. I dont
see why the cup should not be awarded to the winning team in a Canadain
Hockey
league......and we would here again "it's hockey night in Canada" but
with the CHL instead of the NHL


Im sure a lot of CHL players would love it

Nope! They might be the grantors, but certainly not the grantee.
Question still remains, who is the grantee?
If it is ruled to be a private trust, who is the grantee?
Answer that question and the legal process becomes much clearer.
