No. Birthplace is irrelevant. It's where you've done your playing that matters.
He doesn't have to. The agreement is between the AHL and the CHL.
There is no such agreement with the NCAA or any of the European
leagues. If you've never played a game of Canadian Major Junior, then
you can play in the AHL at the age of 18 or 19.
Even if a CHL team has a junior-eligable player's rights, they can't
force a player to play for them. Look at NHL great and future
hall-of-famer Nik Antropov. Antropov was 19 when he signed, and he was
drafted by the Ottawa 67's in the CHL import draft. The Leafs opted to
send Nik to St. John's instead because of his clear superiority to
normal 19-year olds.
Rick DiPietro is the only former NCAA player that I can think of off
the top of my head who's played in the AHL while still junior
eligable.
So basically, the Nucks can do what they want with Kesler now. They
can play him in the NHL, the AHL, the ECHL. If they wanted to, I'm
sure they could arrange for him to play in the CHL. Personally, I'd be
more worried about the fact he isn't a 6'6" Kazakh, but then again,
few are.
